Part 1: What Kinds of Information Do We Collect on the WebMD fit Site?
We do not require visitors to provide any personal information to use or enjoy the Site. However, in order to utilize certain website functionality, children and teenagers must provide the information described below and become a registered user.
In order to allow children and teenagers to register for the Site, We may collect certain information during a registration process. For users under 13 years of age, We do not collect any "personal information," as the term is defined under COPPA. For these users under the age of 13, We only collect a nickname (with an instruction not to use their real name as a nickname), password, birth month and year, zip code and a password hint. For users 13 years of age or older, We may collect additional information during the registration process including personal information such as an email address. We will not condition a visitor's participation in any of the Site's functionality on the visitor providing any more information than is reasonably necessary to participate in a specific activity.
We passively collect certain non-personal information through the standard operation of WebMD fit's Internet servers. This information allows Us to keep the Site running efficiently and to gather statistical information about usage of the Site. The information We collect includes the browser that you use and the operating system you are using. We may also collect other kinds of non-personal information such as your computer's Internet Protocol (IP) address, the number of visits to different pages on the Site and how often a game is played.
A. Contests or Sweepstakes
From time to time, We may provide you the opportunity to participate in contests or sweepstakes on the Site if you are 13 years of age or older. If you participate in a contest or sweepstakes, We will request certain personal information from you. Participation in these contests or sweepstakes is completely voluntary and you have a choice whether or not to disclose this personal information. The requested information typically includes contact information (such as name and address,) and demographic information (such as zip code.) We use this requested information for administrative reasons such as to notify winners and award prizes in connection with the contest or sweepstakes. If the information We collect is used for any other purpose, We will tell you at the time you sign up for the contest or sweepstakes.
We may use a third party service provider to conduct these contests or sweepstakes. The third party service provider will be prohibited from using our users' personal information for any purpose other than to conduct the contests or sweepstakes. Except for these third party service providers, We will not share the personal information you provide through a contest or sweepstakes with other third parties unless we give you prior notice and the opportunity to "opt-out" of having that information shared with such other third parties.
B. Cookies and Web Beacons
We use both session ID cookies and persistent cookies. We use session ID cookies to make it easier for you to navigate our Site. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. We set a persistent cookie to store your password so that you do not have to enter it more than once.
If you reject cookies, you may still use Our site, but your ability to use some areas of Our Site will be limited.
We also use Web Beacons (also called clear gifs) that help us manage content on the Site by informing Us what content is effective. "Web Beacons" are tiny graphics or code that use a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user's computer hard drive, Web Beacons are embedded on Web pages and are about the size of the period at the end of this sentence. We do not tie the information gathered by Web Beacons to any personal information provided by users.
Part 2: How Do We Use and Share the Information Collected from Registered Users on the Site?
Other than as disclosed below, We do not share any information provided by registered users for any purpose. We may share information provided by users when such sharing is required by law and/or when We believe that disclosure is necessary to protect Our rights and/or to comply with a judicial proceeding, court order, or legal process served on the Site, or is otherwise reasonable to protect someone from possible injury. We may also share information provided by users with service providers who help Us facilitate the features and services offered through the Site. These service providers perform services according to Our requirements pursuant to a contract, which states that the service provider may only use the information We provide to perform functions on Our behalf and may not use this information for their own promotional purposes.
In the event of a corporate change in control of WebMD or Sanford resulting from, for example, a sale to or merger with another entity, or in the event of a sale of assets or a bankruptcy, We reserve the right to transfer your information to a new party in control or the party acquiring assets.
