WebMD fit located at (the "Site" or "WebMD fit Site") is designed to offer children and teenagers a safe and secure online environment to learn and play in a dynamic and educational environment.

WebMD fit is a collaboration between Sanford Health ("Sanford") and WebMD LLC ("WebMD"). WebMD and Sanford (collectively or separately, "We", "Us", or "Our") created this Privacy Policy to provide information about privacy, particularly to address any questions from parents of children that use the Site. This Privacy Policy will tell you what information We collect from users of the Site and how We protect that information. This Privacy Policy pertains to this Site only. Please note that WebMD is the sole operator of the Site and any information We collect from users of the Site may only be used by Us in accordance with this Privacy Policy.

The WebMD fit Site is a website developed for children and teenagers. As such, We comply with U.S. privacy laws, including the Children's Online Privacy Protection Act ("COPPA"). By using or accessing the Site, you are agreeing to Our Privacy Policy.

Part 1: What Kinds of Information Do We Collect on the WebMD fit Site?

We do not require visitors to provide any personal information, such as name, address, email address, phone number or other directly identifying information, to use or enjoy the Site.

We passively collect certain other information (non-personal and specific types of personal information under COPPA) through the standard operation of WebMD fit's Internet servers. This information allows Us to keep the Site running efficiently and to gather statistical information about usage of the Site. The information We collect includes the browser that you use and the operating system you are using. We may also collect other kinds of information such as your computer's Internet Protocol (IP) address, the number of visits to different pages on the Site and how often a game is played.

Cookies and Web Beacons

We use cookies for the limited purpose of providing you with access to certain features and functions of the Site and to gather statistical information about usage of the Site (a "cookie" automatically collects information from a visitor to a website and transfers that information to the visitor's hard drive).

We also use Web Beacons (also called clear gifs) that help Us manage content on the Site by informing Us what content is effective. We use a third-party service that uses cookies and Web Beacons to track information about visitors to Our Site in the aggregate to capture usage and volume statistics to help Us improve Our Site.

Upon request WebMD will provide you with information about whether We hold any of your personal information. To the extent We hold any of your personal information, We will retain such personal information as long as needed to provide you services and as necessary to comply with legal obligations, resolve disputes and enforce Our agreements. At any time you can instruct Us to delete any of your personal information that We are holding by sending a customer service request using the Contact Us link at the bottom of every page and We will respond to your request within a reasonable timeframe.

Part 2: Protecting Your Children on WebMD fit and Other Safety Concerns

WebMD fit is dedicated to providing visitors with a safe and fun Internet environment to learn in. We have developed a privacy policy that is focused on protecting users of the Site, including a general policy not to disclose a user's identity on the Site, nor to let a user under the age of 13 disclose his or her identity on the Site. Our intention is to adhere to COPPA and the Children's Advertising Review Unit ("CARU") Guidelines for Advertising on the Internet and Online Services.

We believe that parents should actively supervise and participate in their children's online activities. We recommend that parents or guardians regularly monitor activity on the Site and implement parental controls accordingly.

We do not endorse, recommend or suggest any website, service or content shared on any third-party website including, but not limited to, any third-party website that is linked from the WebMD fit Site. If you click on a link to another website, it is important for you to know that the website may have different policies regarding the kind of information it may collect about you and how this information may be used.

We are not responsible for the policies or practices of any third-party website. You should review the privacy policies of other websites you visit or link to from Our Site to understand how these other websites collect and use your information. You will need to contact those websites directly if you have any questions about their privacy policies or the information the websites collect and how they use that information.

Part 4: Security

As part of WebMD and Sanford's collaboration, WebMD is responsible for developing and operating the Site. The information visitors provide through the Site is captured and stored securely by WebMD. This information may be shared with Sanford subject to this Privacy Policy. WebMD follows generally accepted industry standards and its own best practices to protect the information submitted to WebMD from visitors, both during transmission and once WebMD receives it.

Part 5: With Whom Do We Share Your Information?

WebMD will not disclose any personal information about you unless specifically agreed to by you or:

  • To comply with legal requirements, such as a law, regulation, search warrant, subpoena, or court order;
  • In response to lawful requests by public authorities, including to meet national security or law enforcement requirements;
  • To our vendors in the course of their provision of services to WebMD;
  • In the event of a corporate change in control resulting from, for example, a merger, a sale of assets, or bankruptcy;
  • When we believe in good faith that disclosure is necessary to protect Our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request; or
  • In special cases, such as in response to a physical threat to you or others.

Part 6: Changes to this Privacy Policy

We reserve the right to change or modify this Privacy Policy at any time and any changes will be effective upon being posted unless We advise otherwise. If We make any material changes to this Privacy Policy, We will notify you and your parent or guardian (if applicable) by posting a notice on the Site prior to the change becoming effective. We encourage you to review the Privacy Policy frequently for any changes. Unless stated otherwise, Our current Privacy Policy applies to all information that We have about Our users and their accounts. If you do not accept the terms of this Privacy Policy, We ask that you do not use the Site. Please exit the Site immediately if you do not agree to the terms of this Privacy Policy.

If in the future We make material changes to how We collect or use personal information from children under the age of 13 and if such collection or use requires Us to obtain verifiable parental consent, We will notify parents by email in order to obtain verifiable parental consent or, if We do not have such emails to contact parents directly, by reasonable means on Our website for the new collection or uses of the child's personal information.

Children under the age of 13 are not permitted to contact Us through Our Customer Care page and will need a parent to access this portion of the Site.
